Terms of Service

Plain language, on purpose. If anything below doesn’t make sense, please ask us.
The short version
By using YourHerd you agree to be kind, to be 18 or older, and that this is a place for connection — not a mental health service. We can remove or ban accounts that cause harm. You can leave any time. YourHerd is a small, careful project and makes no promises about uptime or feature continuity.
Who you’re agreeing with
YourHerd is run by James Davin Dillon, an individual in Ohio, USA. These terms are the agreement between you and him for using YourHerd.
You must be 18 or older
YourHerd is for adults. You confirm at signup that you are at least 18 by giving us your date of birth. If we learn an account belongs to someone under 18, we will remove it.
Your account
- Use a real, working email address — that’s how we confirm it’s you, and how we send important notices (verification, password reset).
- Use a fictional handle as your display name. Your real name isn’t required and is mildly discouraged. Don’t impersonate someone else.
- Don’t share your password. You’re responsible for what happens with your account, so keep it to yourself.
- One account per person.
How to behave
YourHerd is built for calm conversation. Please:
- Be kind. Especially to newcomers. Even when you disagree.
- Don’t harass, threaten, or intimidate anyone.
- Don’t post illegal content, hateful content, sexually explicit content, or content that targets a person.
- Don’t spam rooms or anyone’s direct messages.
- Don’t try to break the app, scrape it, or interfere with other people’s use of it.
- Don’t impersonate us, the host of a session, or another person here. Be yourself.
If you see something that feels wrong, please report it. Reports go privately to Davin (in v1, the sole admin), and the person you reported is never told who reported them.
Your safety tools
YourHerd gives you tools to calibrate how present any other person is in your space — mute, block, and hard block. These change only what you see, never what anyone else sees, and the other person is never told you used them. Use them freely. You don’t owe anyone a reason.
Moderation
We can:
- Remove specific messages.
- Remove someone from a hosted session.
- Suspend or ban an account that repeatedly violates these terms, or that causes harm we judge serious.
- In urgent cases, act first and explain afterwards.
We try to be fair. If you think we got something wrong, write to us.
YourHerd is not a mental health service
This is important and protective. YourHerd is a warm place to connect. It is not a mental health service, the people who run it are not therapists, and nothing here is a substitute for professional care.
If you are in crisis or in immediate distress, please reach out to a professional. In the United States:
- 988 — call or text 988 for the Suicide & Crisis Lifeline. Free, confidential, 24/7. You can also chat at 988lifeline.org.
- Crisis Text Line — text HOME to 741741.
- 911 — for immediate physical danger.
These are always available. You do not have to be in crisis to reach out.
Voice sessions
Voice in YourHerd is live only — nothing is recorded by us or on our behalf. Voice opens only during hosted group sessions and one-to-one calls between two people who already chose to connect. The voice service is provided by Cloudflare’s RealtimeKit; your audio passes through their network for the duration of the call and then is gone.
We make no warranties
YourHerd is provided “as is” and “as available.” We do our best, but we don’t promise:
- Uptime (the app may be down sometimes).
- That a feature won’t change.
- That a message you sent will always be retrievable — room messages fade from view after about an hour and are deleted on a rolling 30-day window.
- That the app will be free of bugs.
To the maximum extent allowed by law, YourHerd and James Davin Dillon are not liable for indirect, incidental, special, or consequential damages arising out of your use of the app.
Termination
- You can leave any time. Stop using the app, or delete your account from your profile page.
- We can suspend or ban an account that violates these terms.
If your account is terminated, these terms still apply to the period during which you used the app.
Changes to these terms
If we change something important, we will send you an email and post the new version with the date of the change. Continuing to use the app after a change means you agree to the new terms.
Governing law
These terms are governed by the laws of the State of Ohio, in the United States. Any dispute will be handled in the state or federal courts located in Franklin County, Ohio (or the nearest competent court in Ohio). If you live outside Ohio, you agree to that venue.
